kju.ai AI Pro Subscription Terms

AI Pro is an optional paid subscription that unlocks premium features of the kju.ai service, including continued access to your daily practice sessions. The exact features included in AI Pro are shown in the app at the time of purchase. We continuously develop the service and may add, change, or remove individual AI Pro features over time.

AI Pro is offered as an auto-renewing subscription in one or more plans (for example, a monthly or an annual plan) as presented in the app or on our website at the time of purchase. The price for each plan is shown at the point of purchase in your local currency.

On iOS: payment is charged to your Apple Account at confirmation of purchase. Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current subscription period. Your Apple Account is charged for the renewal within 24 hours prior to the end of the current period, at the price of the plan you selected. You can manage and cancel your subscription in your App Store account settings at any time after purchase. Deleting the app does not cancel your subscription.

On Android: your subscription is billed and managed through Google Play. You can cancel at any time in your Play Store subscription settings; cancellation takes effect at the end of the current subscription period.

On the web: your subscription is billed by our payment processor in accordance with the general Terms of Service, and can be managed from your account settings.

We never collect or store your card details for purchases made through the App Store or Google Play; payment is handled entirely by the respective store.

If you are a consumer in the European Union or the United Kingdom, you have a statutory right to withdraw from a contract for digital services within 14 days of purchase without giving a reason. By starting your AI Pro subscription, you expressly request that we begin providing the subscription immediately, and you acknowledge that you lose your right of withdrawal once the service has been fully performed. Where you purchase through the App Store or Google Play, any withdrawal or cancellation rights offered by the store apply in accordance with its terms. Your statutory rights as a consumer remain unaffected.

We may change the price of AI Pro from time to time. If we do, we will give you at least one month's notice before the new price takes effect. If you do not agree with the new price, you can cancel your subscription before the change applies; the new price only takes effect from your next renewal after the notice period.

Subject to these Subscription Terms and payment of the applicable fees, we grant you a personal, non-exclusive, non-transferable, non-commercial licence to use the AI Pro features for the duration of your subscription. On Apple devices, this licence is limited to use of the app on Apple-branded devices that you own or control, as permitted by the Usage Rules set out in the App Store terms of service.

We may offer a free trial of AI Pro, started explicitly from within the app. Starting a trial does not require any payment details, and the trial does not automatically convert into a paid subscription: nothing is charged when the trial ends. When your trial ends, your access to AI Pro features simply ends unless you choose to purchase a subscription. Free trials are limited to one per person, and we may change or withdraw trial availability at any time.

If a free trial is ever offered through the App Store or Google Play as part of a paid subscription, any unused portion of the free trial period is forfeited when you purchase a subscription.

We provide the AI Pro features with reasonable skill and care. The service may be briefly unavailable from time to time, for example for maintenance or updates; we aim to keep any disruption to a minimum.

If you purchased AI Pro through the App Store or Google Play, refunds are handled by the respective store in accordance with its refund policies — we cannot issue refunds for store purchases directly. Please contact the store through which you purchased. For purchases made on our website, contact us using the details in section 17. Your statutory consumer rights, including any right to a refund where the service is defective, remain unaffected.

The rules of conduct in our general Terms of Service apply in full to your use of AI Pro, including the restrictions on misuse of the service.

kju.ai — not Apple or Google — is solely responsible for maintaining and supporting the app and the AI Pro subscription. To the extent a warranty applies and is not validly disclaimed, in the event of any failure of the app to conform to that warranty, you may (if you use an Apple device) notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app.

kju.ai — not Apple or Google — is responsible for addressing any claims by you or a third party relating to the app or your AI Pro subscription, including product liability claims, claims that the app fails to conform to an applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

To the maximum extent permitted by applicable law, our total liability arising out of or in connection with your AI Pro subscription is limited to the amounts you paid for the subscription in the 12 months preceding the event giving rise to the claim, and we are not liable for indirect or consequential damages. These limitations do not apply to liability arising from our intent or gross negligence (opzet of grove schuld), or in any other case where liability cannot be limited under mandatory law.

All intellectual property rights in the service, including the AI Pro features and all content made available through them, remain with us or our licensors. Nothing in these Subscription Terms transfers any intellectual property rights to you. In the event of a third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, kju.ai — not Apple or Google — is responsible for the investigation, defence, settlement, and discharge of that claim.

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with any applicable third-party terms when using AI Pro, such as the terms of the store through which you purchased.

These Subscription Terms are concluded between you and kju.ai only — not with Apple. Apple is not responsible for the app or its content. However, Apple and Apple's subsidiaries are third-party beneficiaries of these Subscription Terms, and upon your acceptance of these Subscription Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Subscription Terms against you as a third-party beneficiary.

We may update these Subscription Terms from time to time. We will announce material changes at least one month before they take effect, for example in the app or by email. If you do not agree with a change, you can cancel your subscription before it takes effect. Your continued use of AI Pro after a change takes effect constitutes acceptance of the revised Subscription Terms.

These Subscription Terms are governed by the laws of the Netherlands. Any disputes arising from these Subscription Terms shall be submitted to the competent court of Amsterdam, the Netherlands, without prejudice to any mandatory rules that entitle you as a consumer to bring or defend proceedings in the courts of your country of residence.
